Wo are not disposed to attach 
vory great importance to most of tlie 
utterances of the member for Cariboo — 
Capt Evans. Whilst many persons 
Mre willing to concede to him the merit 
of ■ sincerity, they cannot shut their 
eyes to the fant that ho is surprisingly 
credulous and marvelously garrulous; 
and that ho regards a dish of public 
scandal as a toothsome morsel to be 
seasoned with all the condiments, and 
to be iUlowe^to resfcois long = as it will 
;, iioW together on liis gossipy tongue be- 
fore undergoing the process of degluti- 
tion. Few will have forgotten this 
member's verbal assault on a high of- 
ficial two years ago. Because the 
official, whilst in conversation with the 
captain, quoted Walpole's familiar 
saying that "Every man has his price," 
Capt. Evans chose to imagine that he 
.Lad teen "approached," and that an at- 
tempt was being made to buy hi3 vote 
and influence in the House. It will 
be remembered also that the closing 
aeision of the last Parliament was en- 
Hvaned by a question of veracity be- 
tween the captain and a minister of 
the Gospel, from which controversy the 
honorable member emerged somewhat 
the worse for wear and tear. It was 
hoped that experience — if not age — 
would bring wisdom to the captain's 
aid, that he would learn from past dis- 
comfitures to distinguish between hard 
faotsandtliepitifulemanations of village 
gossips and scandalmongers. We find 
that we were mistaken. Pastblundprs 
have taught Capt. Evans nil. He has 
learned nothing. The frosts of many 
winters that sit like a crown on his 
venerable bead serve rather to increase 
than cool the impetuosity of earlier 
years. Ho is as ready as ever to seize 
upon the first opportunity to repeat 
Bcaadalous charges against oflicials, 
• and in accordance with that readiness on 
Monday, in moving the reply to the 
Governor's Speech, he made a grave at- 
tack on the Judiciary of the Province. 
In touching upon. the portion of the 
Speech which referred to the Bench, 
Capt. Evans is rojiorted to have charged 
in substance that the wife and daught- 
ers of a" J udge of the Province had ac- 
cepted presents from a person while 
that person was on trial before the 
husband and father. The manifest ob- 
ject of Capt. Evans was to show that 
those "presents" had been made and ac- 
cepted with a corrupt motive, and that 
they had secured the "person on trial" 
the friendship and support of the learn- 
ed judge. 

This is a very, very grave accusation. 
It is one that should never have been 
made without the fulle.st inforination 
at hand to sustain it; for if conlidcncc 
in the integrity of the Judiciary is once 

' shaken what man amongst us with a 
ri;;bteous cause could enter a court 
with the slightest hope of obtaining 

. justice when opposed by nn unprincipl- 
ed antagonitit armed with a long purse 
or costly "presents." We do not. for a 
moment believe there is an atom of 
truth to sustain the accusation; but the 
country has come, after years of e.\y)er 
ience, to repose confidence in it.s judges, 
and wherever the remarks of the mem- 
ber for Cariboo may be read a feeling 
of surprise, if not of pain, will be e.\.- 
perienced, and a demand for investiga- 
tion will he mada 

■ We have siiid that we do not attach 
much importance to the reckless utter- 
ances of the meniber for Ciiriboo on any 
subject. But in the in.stance undpr re- 
view (we mention it with regret) Capt. 
• Evans acted as the mouthpiece of the 
Government. He was put forward by 
the Government to move the address in 
reply. An address of the kind is a 
cut-and-dried affair, prepared by the 
Ministry, and generally placed in tlic 
hands of the member chosen to s]ieak 
or read to the House. Wan CapUiin

prova-i of the Government before being 
handed to him to present to the House) 
We are inclined to believe that the 
Government, although constitutionalhj 
responsible for Capt. Evans' attack on 
the Bench, were not previously cDn- 
suited as to the propriety of delivering 
what wc have no hesitation in pro- 
nouncing to be an unjustifiable and 
wanton slander upon as pure and high- 
minded a Judiciary as any in the 
■world. Capt. Evans owes it to the 
Government and the country to bring 
on his proof, if he have any, of judicial 
corruption. A charge of tlio kind 
should never be idly made ; but being 
made should not be allowed to pass 
without a demand for the evidence in 
support of it. 

[Since the above article was in t^ pe 
we learn that Ca])t. Evans yesterday 
made a qualified withdrawal in the 
Hou.so, and, as is usual with most men 
who talk too fast, questioned the cor- 
rectness of the report. Messrs. Asri, 
Smitiie, Veenon and Bennett, how- 
ever, rose immediately and asserted 
that the words as reported in The 
Colonist were used by the member, 
The copy of a letter addressed by Jlr. 
Justice Gbav to the Leader of the Gov 
ernmeht has been handed iis for publi- 
cation and will bo found elsewhere. It 
would have been but fair had the letter 
been road to the House. We may say 
that words spoken in tho House are 
not actionable; but there must surely 
be some remedy in law against slander- 
ous attacks oii families or J udges by 
members, or where will the thing end?] 



and we predict that it will not amuse 
the people. The leader of the Opposi- 
tion in ^his reply made some good 
points, and the late Chief Commission- 
er of Lands and Works was eloquent. 
The Government have a strong work- 
ing majority, therefore they have the 
power to "bo useful. Will they use 
this power for tho public good! We 
shall wait a while and watch their pro- 
ceeding with interest The general ex- 
pectation, that they will continue to 
pursue the dignified policy of doing 
nothing at all, will, wo hope, be un- 
realized.

WiNNiPEQ, Man., Jan. 21. — Edward 
Marston, the County Court Clerk, was 
shot by BailifT Alcllroy to-day, the 
former having refused, according to in- 
structions, to give bailifl' executions to 
Mcllroy, who tired his revolver at him. 
Tha ball struck the counter, and, glanc- 
ing off, hit Marston in tho arm, inflict- 
ing a serious wound. The doctors say 
the arm may require amputation. i\Ie- 
Ilroy has been arrested. He claims 
that the shooting was accidental, and 
and that ho was the woi-se of liquor. 

Ottawa, Jan. 17. — Tho Protectionist 
delegates from the Manufacturers' As- 
sociation have not been idle. Last 
night they were entertained at dinner 
by the Hon. ilr. Tilloy, and during the 
course of a conversation ho is credited 
with having reconmiended tho forma- 
tion of a Dominion Manufacturers' As- 
sociation. Shortly before midnight the 
delegates, having returned from the 
dinner, hold a meeting in the Russell 
House for tho jiurpose of carrying out 
tins suggestion. Among those present 
were Messrs. E. Gurney, J. Eiordon, 
W. H. Prazer, E. K. Greene, J. Patter- 
sou, J, Rankin, J. Livingstone, J. H. 
Parker, J. H. McAvity, J. A. Young, 
J. F. Stairs and R. C. W. INIcCuaig. 
After several of the gentlemen had o.k 
pressed their opinions as to the desir- 
ableness of such an organization tho 
election of officers was proceeded -with,

Austria, — ^The deficit in the Prussian 
budget is .said to be no less than 73,- 

500,000 marks, and it can only be met 
by new taxes. It is proposed to in- 
crease tho revenue by moans of new 
duties on, or a government monopoly in 
tobacco, and the German Commission 
recently in this country to inspect our 
tobacco tax system was sent for the 
purpose of perfecting such changes in 
tiio German system as will yield the 
needed increase in revenue. German 
manufacturing interests aro said to iie 
suflbring from tho active competition of 
Austro-Hungary, where labor is cheap, 
and where the raw material is obtain- 
able, through tho port of Trieste, cheap- 
er than Germany can got it. Austria 
is the largest consumer of East Indian 
and Egyptian cotton, which she gets 
from Alexandria and through the 
Suez Canal by the most' direct routes. 
Tho finances of Austria are, however, 
in a much more desperate condition 
than those of Germany or Prussia, and 
the murmurs of discontent which rise 
up from Hungary and Bohemia grow 
louder every day. Tho annual interest 
upon thn Austro-Hungarian debt has 
increased 18,000,000 guilders since 
1873, and is now 96,000,000 guilders. 
Tho occupation of Bosnia and Sorvia 
requires 200,000 men, and has alrendv 
caused anexpen.soof 1-10,000,000 guild- 
ers. Tho nawspaj)ors of Pesth and 
Vienna declare that tho dual kingdom 
will be ruinod unless the occupation 
ceases. Austria's trouble is greatly 
augmented by her currency of irre- 
deemable pa I or money, which has been 
almost unmanageable for so many

rather turned his head. He began to

had in tho most unmistakable manner in- 
ainuatcd that corruption existed where of 
all other places it ought not to be found, 
that is tho Supreme Court of the Province. 
Tho hon. gcntlcni:iii had been, from his 
£rst entrance to the House as a mcnibcr, 
in tho habit of inakinc; charges against 
gontlomon filling the highest oflices; 
against gentlcnien, ton, whose position j 
rendered them almost ontirely defence- i 
less against sucli outrageous attacks. He [ 
(Mr. S.) considered that the House in : 
self-defence ought to show on this occasion | 
that it rejected with loathing tho assassin- I 
like attack by demanding from the mem- 
ber for Cariboo a distinct retraction of | 
his language, or require him to mako 
good his position by openly making ii direct 
and definite charge against the party his 
insinuations were intended to injure, so 
that the matter might bo investigated and 
sifted to tho bottom. (Hear, hear.) He 
(Mr. S.)would say again, the thing should 
not be allowed to rest with Capt. Evans' 
denial of tho correctness of The Culoni.tt's 
report. Ho ought to repeat wlintlio real- 
ly did aay, and then in a manly manner 
retract it or else substantiate his charge 
80 that a rigid enquiry ni:iy bo instituted, 
and corruption bo unearthed or innocence 
vindicated. (Hear, hear). 

Mr. Vernon said if tlio report was 
incorrect tho hon, gentlcin.an sliould rise 
and explain in what particular it was so, 
for as far as ho eould remember the re- 
port was a very fair one. The question 
at present was ono of .adjournment, hut 
ho hoped hon. gentlomoii would waive 
thoir privilege and domaiid a thorougli e.x- 
planation as it was a most imiiortant mat- 
ter and one in which both sides of the 
House were equally interested. If the 
languago attributed to him was incorrect, 
he trusted Uie hon. gentleman would at 
onco state to tho House what ho really 
did s.iy, and either distinctly retract the 
imputation or inform tho House to which 
judge he referred. Had tho .\ttorney- 
Gcnoral been in his place at the time he, 
no doubt, would h.ave checked the hoii. 
gentloman in his remarks and protected 
the judges from such unwarrantable in- 
sults. 

Hon. Mr. Walkcm said ho was not in 
tlio H0U.SO at the time and so could not 
say whether tho rcpoit wa.s correct or not; 
but the lion, gentleman had denied this, 
while other lion, gentlemen opposite 
had stated that there could be no doubt 
OB to what ho meant. Ho had received a 
letter from Ml-. Justice Gr.ay calling for 
an oxplaniition and he was glad tho hon. 
gentleman had now given it; but aa to 
whether what the hon. gentlemen oppo- 
site s!ud was correct or not, ho must leave 
in Mr. Evans' own hands. 

Mr. Bennett said he had ho:ird the hon. 
gentleman yesterday with iiidignation. 
Though tho report was not literally cor- 
rect yot it was subslantially so, for he 
left no doubt in hon. gentleman's minds 
but that ho rofon-cd to ono of tho judges 
and he thought the House should demand 
a full and explicit denial of what had 
taken ])laco. 

Mr. Wilson hoped tho Imn. mcuiber for 
Cariboo would tat 6 no furtlier notice 
of tho matter.

lied, for it said Mr. Evans commenced

a list of voters. 

Hon. Mr. Walkom laid on the table 
railway dispatches and a letter from Mr. 
Scott dated Juno, 1870, concerning the 
Biite Inlet route, which had never been 
laid before the House, but suppressed by 
the late Government. 

Mr. Sniithe asked tho hon. gentloman 
when and where the suppression h.id 
taken place? • 

Mr, Walkom said tlio dispatch was 
received by tho lato Government. 

Mr. Smithe said it had been suppressed 
by tho present Government, in that it was 



only received a few days before tho Elliott 
Government went out of ofhccj and had 
been left for the incoming Govemmont to 
deal with, as itwasnot considered right for 
a defeated Governineiitto''d^int^.B^i'°' 
portant a subjecf^when the new Govern- 
ment would assume power in a, few d.ays. 
It was known that tho present Govern- 
ment acted on these dispatches and ha 
thought that they were to blame for the 
suppression. 

Mr. Walkom said the hon. gentloman 
was mistaken, for the' dispatch produced 
was received by 'Mr. Trutch and a copy 
sent to tho E.\ecutivo Council on tho 4th 
July, 1870. Tho dispatch was oven with- 
held from Mr. Humphreys, who w>as then 
in tho Ministry. This had iiovor boon 
published oven in Canada itself. 

Hon. Mr. Humphreys said that though 
a member of tlio Ministry at the time lie 
had never soon the dispatch till a few daj-s 
si.nce. 

Mr. Vernon said that this was a most 
important matter and thought that a com- 
mittee should bo appointed to investigate 
it. If any ono w;is to blamo for its sup- 
pression ho could not but think that it 
must bo tho hon. gentloman who had just 
sat down, iis ho was at the time, olork of 
the Executive Council and therefore re- 
sponsible for all documents brought down 
to tho Council. 

Hon. Mr. Walkeiu said the hon. gentle- 
man could draw up a committeo at onco. 

Mr. Smithe said that he referred to a 
later document and was not aware of tho 
oxistonco of the ono now ijroduccd, which 
ho had mistaken for one of ;i later d:ito. 
Tho clerk of tho E.xocutivo Council at the 
time was tho Hon. Mr. Ilumphroys and 
he would be responsible for all documents; 
ho would receive it from tho Lieutenant- 
Governor and present it to his colloaguos 
and would again, after that, become tho 
responsible custodian. 

Dr. Ash said ho would like to hear the 
hon. member for Yido, wiio w.a.s in tlio 
Government at the time, state that he 
had never soon the dispatch. 

Mr. Vernon said that as far as lie eould 
recollect ho had never seen tho document 
before. Every document that he oversaw 
had been seen by Jlr. Ilumphroys and all 
the other members of the Executive. As 
far as the doounient w.as concernod ho 
saw notiiing in it to warrant any Govcrn- 
iiieiit siipiiressing it and tluiught that tho 
Provincial Secretary Blioiild refrain from 
further discussion uu this till a cuaunitlco 
should enquire into it and report. As tho 
House w.a3 desirous of knowing whether 
any suppression had taken place or not he 
would move tluit tho following bo ap- 
pointed a coniniittee of enquiry: Mes.srs. 
Ash, Bennett, Abranis, Harris and Wilson. 

jMr. Wilson seconded tho motion, as ho 
considered tho dispatch a moat important 
one. ' * 

Hon. Mr Boavon said that~in August, 
1870, it was rumored that nn important j 
dispatch had been received by the Gov- 
ernment and a deputation which waited 
on the leader of tho Government to ascer- 
tion whether such was tho case, were in- 
formed that no dispatch had been receiv- 
ed. It was a peculiar fact that this docu- 
ment had been suppressed by both tho 
Provinciiil and Dominion Governments. 

Hon. Mr. Ilumplueys said it was not 
conceivable that so important a document 
should bo forwarded to him and that ho 
should withhold it from his colleagues. 
Ho regretted tiiat any imputation or slur 
had been cast on him for ho had stated 
point bl.ank that ho li.id never soon the 
document. 

The motion was carried and tho House 
.adjourned till 2 p.m. Wednesday.

The following letter has been addressed 
by tho Hon. Justice Gray to the leader 
of the Govuniinent, but was not read in 
Hou.so yesterday: --

Sm:— My attention h;i3 been called to 
tho following passage in the speech of 
Capt. Evarm, ono of the moiabers from 
Cariboo, as reported in T/ie Colonint news- 
paper, made yesterday in tho Houso, in 
moving the address in reply to tho Speech 
from the Throne, namely: 

."Referring to prison discipline ho was 
glad to find that the Chinese were now de- 
prived of their queues. It w.as to be re- 
gretted that tho Chinese Act of last ses- 
sion had not been left for tho decision of 
the Dominion Govemmont and not have 
been allowed to bo quashed by Judges 
here; but this would bo reinodied shortly. 
The Judges here should bo above sus- 
picion, and what must tho people think 
when the wife and daughters of a Judgo 
who is trying a ciise is allowed to receive 
presents from the person on trial; this 
should not bo and he trusted would bo 
stopped," 

' As the observations appear connoctod 
with tho Cliineso Question — and I am the 
only Judge of the Supremo Court before 
whom th.at question lias been brought, 
and who adjudged the Bill referred to to 
bo unconstitutional — the other two Judges 
being in no way responsible for my acts 
or decisions — have to request you, as 
the leader of the House, to put in tho 
Houso to-day the distinct categorical 
question — whether I ain tho ,Tudgo re- 
ferred to, and whether the allegation 
therein contained has any roferencq to 
my family, at the same time demanding a 
statement of tho circumstances. 

If tliat assertion be true it is tho duty 
of tho Legislature to call upon tho Domin- 
ion Govoriiineiit for my iniuiediato dis- 
missal. It it 1)0 untruo — aiul 1 pronounce 
it an unqualified falsehood — then in the 
interest of the public it should bo at onco 
contradicted and withdrawn. 

I pray you that there bo nothing equiv- 
ocal or private either in the demand or 
reply; but that you will li.avo both made

Mr. Smithe will move the following re- 
solutions to-day in the House : — 

Whereas, oontnu^ to the pledge of the 
Leader of tho Government last Session, 
tlio "Land Act Amendment Act, 1878," 
has been api>licd in cases of lands held by 
pro-emption. 

And whereas it is contrary to the letter 
and .spirit of all previous Land Acts to 
charge an usurious rate of interest upon 
tho unpaid purchase money of tho hold- 
ings of actual settlors, and contrary also 
to tho spirit which ha.s over characterised 
the legislation of the country with refer- 
once to tile Crown Lands of the Province, 
settlement upon which it has been the 
especial aim and endeavor of each succes- 
sive Legislature since Confederation to

be rendered the building was totally de- 
stroyed. Some Indians had been en- 
camped near tho property recently, and

posed that they left behind them tho rem- 
nants of their camp'firo without properly 
e.xtiiigui.shing the same, and that with the 
assistance of a strong lireezo which was 
blowing at tho time the llamca were com- 
inunioatod to tlie house and thus caused 
the conflagration. Dr. Kibbe and family 
were to have taken possession of the 
house yesterday and had even sent on a 
quantity of furniture, etc., before it was 
known that the houso had boon destroy- 
ed. There was no insurance on the 
building, wjiich cost between $G00O and 
87000 when first built. 



"Supprossod."' 

A dispatch from the Ottawa Govern- 
ment, dated Juno, 1870, and addressed 
to the then Lieut.-Oovernor (Mr. Trutch) 
was laid before tho House by ilr. Walkem 
yesterday. Mr. Walkom remarked that 
it had boon "Suppressed by the.Iato Gov- 
ernment." All the members of tho lato 
Government present (including Mr. Hum- 
phreys) denied having had any knowledge 
of tho existence of the dispatch prior to 
yesterday, and a committeo was struck on 
motion of I\Ir. Vernon. The dispatch re- 
quested tho B. C. Government to convey 
certain lands for a lino of railway to be 
constructed from Fort George to Yollow- 
liead Pass. Tho request was not complied 
with. The dispatch would s'ocin to indi-

Social. — The Presbyterian social last 
night was a success. The music, vocal 
and instrumental, was first-class. A bur- 
loaquo on " Lord Ullin's daughter," by 
J. Stewart, was well dono and "Tho 
Stage-Strnck Hero " by the same gentle- 
man attracted the attention of tho critics 
and they applauded. But the acting of 
the charado created roars of laughter.

shown ill a church near Newcastle,
